                   	     ORDINANCE NO. 9566
                  
                  
                   AN ORDINANCE ABANDONING A TEN (10) FOOT
                   SANITARY SEWER EASEMENT IN HERITAGE LANDING
                   UPON CERTAIN CONDITIONS.
                  
                   	     _______________________
                  
                  
                  
              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby
         abandoned a 10 foot sanitary sewer easement in Heritage Landing 

         crossing Lot 4 of the subject subdivision, as shown on plat
         attached hereto and made a part hereof by reference.
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this
         abandonment is made subject to the following conditions:
                1. The existing 8-inch sewer line will be relocated
                   by the owner as shown on the attached map and
                   plugged at the manholes at each end of the
                   relocated line.
               
                2. The removal of the existing 8-inch sewer line
                   beneath this sewer easement in the development
                   of the subdivision.
               
                3. An as-built drawing of the relocated sanitary
                   sewer line and the inspection, testing, and
                   acceptance of the new sewer line by the City.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
